THE ILVA CASE, THE LEGAL ISSUES RAISED BY THE PROCEEDINGS

The current ILVA issue has required putting aside an emotional approach, which has characterized this matter of high socio-environmental impact, in order to make space for a lucid and rational analysis of the legal issues raised by the ongoing proceedings and by the judicial orders which have required personal and real precautionary measures. After a short close-examination of the legal case, Dario Bolognesi dealt with the delicate relationship between AIA (Autorizzazione Ambientale Integrata – Integrated Environmental Authorization) and the diffuse and fugitive emissions, in order to assess whether such non-conveyed emissions produced by ILVA plant in Taranto (Europe’s largest steelworks plant) in excessive quantities, are to be considered illegal. Subsequently, Dario Bolognesi examined the charges of environmental disaster and omission of precautions by the plant manager.
